These Terms of Service (“Terms”) govern your use of elementaryskincare.com.au (the “Site”) and any purchase you make from Elementary Skin Care (“we,” “us,” “our”). By using the Site or placing an order, you agree to these Terms. Please read them carefully.
1. ABOUT US
Elementary Skin Care is a sole trader business handcrafting natural, plant-based skin care in small batches from our Melbourne studio and sell online via this Site and by appointment at our home store in Templestowe Lower, Victoria, Australia.
2. USE OF THIS SITE
You may use this Site to browse and purchase our products for personal or, where agreed with us in advance (e.g. stockist arrangements), business use. You agree not to:
• Use the Site for any unlawful purpose or in a way that could damage, disable, or impair it
• Attempt to gain unauthorised access to any part of the Site or our systems
• Copy, reproduce, or resell our content or product images without permission
• Submit false or misleading information when placing an order or creating an account
3. PRODUCTS AND PRODUCT INFORMATION
We make every effort to describe our products, ingredients, and images accurately. However:
• Because our products are handmade in small batches from natural, plant-based ingredients, slight variations in colour, scent, and texture between batches are normal and not considered faults
• Screen settings can affect how colours appear — the product you receive may look slightly different from your screen
• We reserve the right to modify formulations, packaging, or discontinue products at any time
4. SKIN CARE AND PATCH TESTING
Our products are intended for external cosmetic use only and are not a substitute for medical advice, diagnosis, or treatment.
As with any new skin care product, we recommend performing a patch test 24–48 hours before first use, particularly if you have sensitive skin, known allergies, or an existing skin condition.
If you experience irritation or an adverse reaction, discontinue use immediately and consult a healthcare professional. If you are pregnant, breastfeeding, or have a specific medical condition, we recommend checking with your doctor before using any new skin care product, including ours.
5. ORDERS, PRICING AND PAYMENT
• All prices are listed in Australian dollars (AUD) and include GST where applicable
• Prices are subject to change without notice, but the price you pay is the price displayed at the time you complete your order
• We accept payment via the methods shown at checkout (currently credit/debit card, PayPal and Afterpay)
• We reserve the right to refuse or cancel an order — for example, in cases of suspected fraud, pricing errors, or stock unavailability — in which case you'll receive a full refund
6. SHIPPING AND DELIVERY
Shipping timeframes and costs are set out on our Shipping & Terms of Trade page. We currently dispatch within Australia and internationally; estimated delivery times are provided as a guide only and are not guaranteed, as they depend on couriers and customs processes outside our control.
7. RETURNS AND REFUNDS
Our approach to returns, exchanges, and refunds — including for faulty or change-of-mind items — is set out in full in our Return & Refund Policy.
Nothing in these Terms limits your rights under the Australian Consumer Law.
8. INTELLECTUAL PROPERTY
All content on this Site — including text, product formulations, photography, logos, and design — is owned by or licensed to Jennifer Bache and Elementary Skin Care and is protected by copyright and trademark law. You may not reproduce, distribute, or use our content commercially without our written permission.
9. STOCKISTS AND WHOLESALE
If you are approved as a stockist or wholesale partner, separate wholesale terms (pricing, minimum orders, and territory arrangements) will apply in addition to these Terms. Please contact us for details.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Elementary Skin Care is not liable for any indirect, incidental, or consequential loss arising from your use of the Site or our products. Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

Our Site may use or link to third-party services (such as our payment processors, shipping carriers, or social media platforms). We are not responsible for the content, privacy practices, or performance of these third-party services.
